Distance contract

This Distance Contract defined e-commerce terms and conditions of ADVENTICA (hereinafter referred to as "Terms and Conditions") apply to purchases of Goods made on the adventica.lv website.

We recommend that you read these Terms and Conditions carefully before using our online store. We reserve the right to change these Terms and Conditions without prior notice.

1. Definitions of terms

ADVENTICA means the company SIA Jautra, registered and operating at Āzenes iela 5, LV-1048, Rīga, Latvia, company number: 40203264116, registered in the Commercial Register of Republic of Latvia.

ADVENTICA Park means the business premises of SIA Jautra, marked "ADVENTICA" at shopping center "Olimpia" at Āzenes iela 5, LV-1048, Rīga.

Website means the website under address www.adventica.lv 

Terms of Personal Data Protection means the personal data protection conditions available on the Website

Entrepreneur means a natural or legal person who, when concluding and fulfilling a contract, acts within the scope of his business activity, employment or profession

Payment Method means one of the payment methods chosen by the Customer in the order creation process, the payment methods are defined in Article 2 of the Terms and Conditions

Goods mean a voucher, a birthday reservation or a gift certificate, provided in digital format

Customer means any person who actually uses the services of ADVENTICA. If the Customer is a minor, the Customer means an adult accompanying the Customer or his legal representative, as well as the person who ordered ADVENTICA’s services.

The relationship between ADVENTICA and the Customer is governed by laws of the Republic of Latvia.

2. Payment Methods

ADVENTICA processes all the payment, while its technical implementation is offered to ADVENTICA's Customers through MakeCommerce platform (https://makecommerce.lt/) with the following Payment Methods: either by banklink with all major Latvian banks or by all major credit cards. 

Additionally, Customers are allowed to make payments by manual bank transfer from any bank of Customer's choice to the ADVENTICA bank account provided during online purchase process for such payment method.

All payments are processed in euros. If the transaction currency differs from the payment currency, the transaction amount will be recalculated according to the card transaction rate on the day of settlement of the issuing bank at the Customer's expense.

3. Methods of transport

Since ADVENTICA offers Goods of an intangible nature, the Goods are delivered to the Customer exclusively electronically to an e-mail address.

4. Ordering the Goods

When ordering Goods on the Website, the Customer is obliged to provide the following information: Goods, quantity of Goods, first and last name, telephone number, e-mail address. 

A Customer who is an Entrepreneur is obliged to state the name of the company, ID number, registered office or place of business and, if he is a VAT payer, also the VAT ID number. In the case of an Entrepreneur based abroad, ADVENTICA reserves the right to provide additional proof of the data provided in the order.

The Customer is obliged to choose a Payment Method.

Before confirming the order, the Customer is obliged to carefully check the contents of his order, the total price of the order and express his agreement with the Terms and Conditions and Terms of Personal Data Protection by ticking the box.

After clicking on the "Order with payment obligation" button, the Customer will be redirected to the payment gateway depending on the selected Payment Method. In it, the Customer will enter the data necessary to make the payment:

  • for credit cards: the name on the payment card, the payment card number, its validity date and the CCV verification code,
  • for banklink: bank account authentication information,

and will proceed according to payment instructions.

All prices are offered with VAT included. They are also displayed on the Website, as well as shown during the order process.

ADVENTICA is not responsible for any malfunctions during the online payment process. When paying, the Customer is responsible for having sufficient authorization to use the payment card or access to the bank account, as well as for the correctness of the data provided. The Customer is also responsible for any damages that arise as a result of the wrong e-mail address being entered in the order.

After completing the purchase, the Customer will be shown the following purchase data: order identification number and order time. The Customer will then receive a confirmation e-mail with a summary of the order and information about the processing of the order in the attachment of the confirmation e-mail to the e-mail address specified in the order. If the Customer chooses the method of payment via bank transfer, he will also receive the necessary payment data for making the bank transfer.

After processing the order and crediting the price for the order to ADVENTICA's account, usually within 48 hours from the day of receipt of the order, the Customer will receive the Goods and an electronic invoice to the specified e-mail address.

ADVENTICA sends vouchers, birthday reservation and gift certificates to Customers in electronic form, which contain a QR code, which the Customer will use to identify himself when entering the ADVENTICA Park. The Customer can also print the ticket with the QR code.

The Distance Contract is concluded after the Customer is sent the Goods in igital format. ADVENTICA for online purchases provides Goods only in digital format (QR code or PDF document).

5. Withdrawal from the purchase contract

The Customer is not entitled to withdraw from the purchase contract for birthday reservations, considering that the sale of the Goods represents the provision of services associated with leisure activities, which are provided at the agreed time or within the agreed period in accordance with the Consumer Rights Protection Law of the Republic of Latvia. It applies when selling goods or providing services based on a contract concluded at a distance or a contract concluded outside the seller's premises.

For the vouchers and gift certificates, which do not have a specific date assigned to them, are subject to the 14 day withdrawal period. This applies only to the vouchers and gift certificates that have not been used, and are paid. For Customers wishing to withdraw from the purchase contract and get reimbursement for the Goods, they must contact ADVENTICA at [email protected] withing 14 days of the purchase. 

At its discretion, ADVENTICA may provide other Goods as a replacement. The Customer has no legal right to such compensation.

6. Defects of the Goods, instruction on the defects of the Goods, complaints about the Goods

The ADVENTICA is in accordance with the laws of the Republic of Latvia defining actions on defects in Goods.

If it is a defect that can be removed, the Customer has the right to have it removed free of charge, on time and properly. ADVENTICA is obliged to remove the defect without undue delay. Instead of removing the defect, the Customer may demand the replacement of the Goods, or if the defect concerns only a part of the Goods, the replacement of the part, if this does not result in disproportionate costs for the ADVENTICA considering the price of the Goods or the severity of the defect. Instead of removing the defect, the ADVENTICA can always replace the defective Product with a defect-free one, if this does not cause serious difficulties for the Customer.

If it is a defect that cannot be removed and which prevents the Goods from being properly used as Goods without defects, the Customer has the right to exchange the Goods or withdraw from the purchase contract. The same rights belong to the Customer if the defects can be removed, but if the Customer cannot properly use the Goods due to the reappearance of the defect after repair or due to a larger number of defects. If there are other irreparable defects, the Customer has the right to a reasonable discount from the price of the Goods.

ADVENTICA undertakes to handle any complaint no later than 30 days from the day the complaint is made. The deadline for processing the claim begins on the day following the day the claim was made. ADVENTICA undertakes to properly and timely inform the Customer of the method and processing of the claim and the current status of processing the claim. ADVENTICA will do its best to make the response as immediate as possible.

7. Alternative dispute resolution

ADVENTICA undertakes to resolve potential disputes with Customers primarily by mutual agreement to the Customer's satisfaction. In case of any disputes or violation of the Customer's rights, please contact our customer support at [email protected].

If ADVENTICA (i) fails to resolve the disputed event in a proper and timely manner or (ii) rejects the Customer's claim or (iii) rejects or fails to remedy the perceived violation of the Customer's rights, the Customer shall have the right to resolve the dispute out of court by contacting an alternative dispute resolution entity, e.g.: the Latvian Consumer Protection authority, for more information visit: https://www.ptac.gov.lv. 8. Final Provisions

These Terms and Conditions are available on the Website.

All matters not regulated by these Terms and Conditions are governed by the laws of the Republic of Latvia.
